dc.description.abstractThis research aims to highlight a current and relevant issue, which is domestic violence against women, plus the role of the judicial police in combating it. Although the most diverse forms of violence against women are already duly regulated and criminalized, it is known to everyone that gender violence has not been decreasing, on the contrary, it has been gradually increasing, according to rates that will be demonstrated throughout this research, which denotes a social and cultural problem. In order to better clarify the origin of such misogyny, and in an attempt to break with stereotypical patterns that do nothing to combat domestic violence against women, such research will start from a historical context, bringing to light the historical evolution of women's rights in Brazil, through the International Human Rights Treaties and Conventions to which Brazil is a signatory and which implemented women's rights, until the conception of Law nº11.340/2006, better known as the Maria da Penha Law. This law is a national law, the birth of which occurred only after Brazil was condemned by the Inter-American Commission on Human Rights/OAS. In addition to the normative scope, the research aims to clarify the essential role that the entire women's protection network plays in combating Domestic and Family Violence, in particular the role played by the Judiciary Police, an opportunity in which the role of Specialized Police Stations in combating to Violence against Women and the consequent evaluation of the benefits of using restorative practices within the police sphere. The aim of this research work is to encourage debate and publicize the work that the entire protection network carries out in combating this type of violence, especially the role of the Judiciary Police, women's access to justice, the role of the judiciary in resolving this type of conflict, of the State in terms of creating and executing public policies aimed at combating Domestic Violence, and not least, the role of Society and the family, in instilling the responsibility that each person carries within themselves, through a paradigm shift, in an attempt to remove the structural machismo that haunts generations. Therefore, current and relevant topics will be addressed, provided for in law and International Human Rights Treaties for the protection of women with a view to bringing solutions to the problem of Domestic Violence, with the aim of eradicating, or at least minimizing such an insolent practice, and at the same time so common in the 21st Century, when women already choose their representatives, occupy spaces and assume power, but sometimes suffer the most diverse types of violence, simply for being women.
dc.description.resumoA presente pesquisa tem como objetivo ressaltar tema atual e relevante, que é a violência doméstica e familiar contra as mulheres, acrescida do papel da polícia judiciária em tal enfrentamento. Embora as mais diversas formas de violência contra a mulher já estejam devidamente regulamentadas e criminalizadas, é do conhecimento de todos que a violência de gênero não vem sofrendo decréscimo, ao contrário, vem aumentando paulatinamente, segundo índices que serão demonstrados ao longo da presente pesquisa, o que denota um problema social e cultural. Com o fim de melhor esclarecer a origem de tamanha misoginia, e na tentativa de romper com padrões estereotipados que nada contribuem no combate à violência doméstica contra a mulher, tal pesquisa partirá de um contexto histórico, trazendo à tona a evolução histórica dos direitos das mulheres no Brasil, transcorrendo os Tratados e Convenções Internacionais de Direitos Humanos de que o Brasil é signatário e que concretizaram os direitos das mulheres, até a concepção da Lei nº 11.340/2006, mais conhecida como Lei Maria da Penha. Tal lei trata-se de uma lei de âmbito nacional, cujo nascedouro se deu apenas após o Brasil ser condenado pela Comissão Interamericana de Direitos Humanos/OEA. Além do âmbito normativo, a pesquisa visa esclarecer o essencial papel que toda a rede de proteção à mulher exerce no combate à Violência Doméstica e Familiar, em especial o papel desempenhado pela Polícia Judiciária, oportunidade em que será demonstrado o papel das Delegacias Especializadas no combate à Violência contra a Mulher e a consequente avaliação das benesses em se utilizar de práticas restaurativas ainda no âmbito policial. Busca-se, com o presente trabalho de pesquisa, fomentar o debate, divulgar o trabalho que toda a rede de proteção realiza no combate a esse tipo de violência, em especial o papel da Polícia Judiciária, o acesso da mulher à justiça, o papel do judiciário na resolução desse tipo de conflito, do Estado quanto à criação e execução de políticas públicas voltadas ao enfrentamento da Violência Doméstica, e não menos importante, o papel da Sociedade e da família, ao incutir a responsabilidade que cada um carrega em si, por meio de uma mudança de paradigma, na tentativa de afastar o machismo estrutural que persegue gerações. Serão abordados, portanto, temas atuais e relevantes, previstos em leis e Tratados Internacionais de Direitos Humanos de proteção à mulher com vistas a trazer soluções ao problema que é a Violência Doméstica, com o objetivo de erradicar, ou ao menos minimizar prática tão insolente, e ao mesmo tempo tão comum em pleno Século XXI, quando as mulheres já escolhem seus representantes, ocupam espaços e assumem o poder, mas
