Desafios para o aprimoramento da gestão e fiscalização de contratos de mão de obra terceirizada no Tribunal de Justiça do Estado de Goiás

| dc.description.abstract | This study investigates the challenges in improving the management and oversight of outsourced labour contracts at the Court of Justice of the State of Goiás (TJGO). The research is justified by the need to ensure efficiency, transparency, and legal certainty in the use of public resources, particularly in light of an intensive administrative workflow which, in the 2025 cycle alone, anticipated over 450 items for procurement. The primary objective is to identify the main obstacles faced by managers and supervisors in optimising the process, considering the TJGO’s organisational structure. Grounded in New Public Management theory and the evolution of Brazilian administrative models — from patrimonialism to managerial administration — the theoretical framework discusses how outsourcing allows the institution to focus on its core activities, whilst requiring rigorous control to mitigate the risks of vicarious liability. Methodologically, this is qualitative, exploratory, and field-based research using an inductive approach. Data collection took place between January and February 2026 through semistructured interviews with ten civil servants from the Goiânia Judicial District Directorate. Data processing employed Bardin’s content analysis method, supported by technological tools such as aTrain for transcription (in compliance with the LGPD) and Voyant Tools for textual analysis. The results reveal a consensus on the need for automation and integrated systems to mitigate human error and improve interdepartmental communication. Technical training was identified as a critical issue for the majority of interviewees, highlighting that while the importance of oversight is recognised, gaps remain in the mastery of tools such as the Result Measurement Instrument (IMR). The study concludes that the TJGO’s management model possesses an adequate normative basis; however, its effectiveness is limited by insufficient human resources, the technical complexity of contract renegotiations, and an over-reliance on individual staff performance. | dc.description.resumo | O desenvolvimento econômico e social de um país é fundamental para que seus habitantes vivenciem uma dignidade plena. Entretanto, essas circunstâncias são impactadas diretamente pela interação entre os sistemas econômicos e regulatórios que permeiam o cotidiano das empresas, do emprego e da comunidade. Assim, a pesquisa visa responder ao seguinte problema: O Brasil, por meio da Constituição Federal de 1988 (CF/88) e o atual modelo de desenvolvimento econômico, consegue desenvolver o capitalismo humanista (livre iniciativa com justiça social) a partir da função social da empresa? A presente pesquisa tem como objetivo geral analisar o capitalismo humanista como alternativa para garantir uma sociedade justa por meio da função social da empresa. Para tanto, necessário analisar a relação entre capitalismo humanista e justiça social, compreender a função social da empresa e suas implicações no desenvolvimento econômico; e identificar os princípios do capitalismo humanista nas normas constitucionais e econômicas das empresas. Adotou-se uma abordagem metodológica que combinou a abordagem qualitativa com o método hipotético-dedutivo. Realizou-se uma análise crítica e interdisciplinar da legislação pertinente ao tema, de textos jurídicos e constitucionais, da jurisprudência dos tribunais superiores, e da literatura sociológica e filosófica. A pesquisa demonstra que a evolução histórica do Estado brasileiro, do patrimonialismo ao Estado Democrático de Direito, consolidou um paradigma liberal-garantista na CF/88, no qual a liberdade econômica só se legitima quando vinculada à justiça social e à dignidade da pessoa humana. A análise da teoria do capitalismo humanista, proposta por Sayeg e Balera, revela uma possível síntese entre livre iniciativa e responsabilidade social. Conclui-se que a CF/88, especialmente por meio do art. 170, fornece fundamentos jurídicos suficientes para viabilizar o capitalismo humanista por meio da função social da empresa. Contudo, a efetividade dessa proposta enfrenta barreiras históricas, culturais e institucionais decorrentes da “modernidade atrasada” brasileira, o que dificulta a plena transição para um modelo garantista. A conciliação entre crescimento econômico e justiça social é juridicamente possível, mas requer densificação jurisprudencial, regulamentação infraconstitucional e atuação conjunta e comprometida do Estado, das empresas e da sociedade civil organizada. | |
