This paper analyzes extrajudicial adverse possession from the perspective of the social function of law, highlighting its relevance as a mechanism for real estate regularization and democratization of access to property. This study begins with an examination of the normative evolution that resulted in Article 216-A of the Public Registry Law and its consolidation after ten years of the 2015 Code of Civil Procedure, highlighting the strengthening of extrajudicial procedures and the technical-legal activity developed by notaries and registrars. It also examines the constitutional function of administrative adverse possession, especially regarding the fulfillment of the social function of property, the right to housing, administrative efficiency, and adequate access to a just legal order. The study demonstrates that registration qualification plays an essential role in stabilizing ownership and ensuring legal security in the real estate registry, contributing to the reduction of litigation and the integration of consolidated possessions into the formal system. The study also compares the institute to foreign models and proposes regulatory improvements, suggesting the elimination of the need for a site plan and descriptive report for urban properties already registered with a precise description, as a way to increase the speed and cost-effectiveness of the procedure, without compromising the structuring principles of property registration. It concludes that extrajudicial adverse possession, by aligning technique, efficiency, and social function, constitutes an essential instrument for the realization of fundamental rights and the strengthening of the Brazilian registration system.
