The object of the analysis is the ethical and economic factors that, considered as political elements directly responsible for the conception of the State, they are established as foundations of philosophical, social and legal theories that have the capacity to shape the structure of human relations in the face of interests that circulate between individuality, self-preservation and the desires and needs of the body society in which the individual, as a subject to which the purposes of the instituted political power are addressed, is inserted. This analysis is directed to the contemporary understanding of the objectives of the State and the acts of economic intervention, apparently inevitable, that through the coercibility of the law, in the context of the development of constitutionalist ideals, seek to rescue the ethical precepts recognized as instruments capable of providing the balance between the free initiative advocated by the capitalist market, whose purpose is to economically satisfy the desires of a self-interested behavior, and the pressing needs of the social body that are established as objectives of the State molded, in its historical evolution, on the precepts of social and universally human values . This examination is linked to the constitutional order of the Brazilian State, which is conceived in the work as an object of analysis in relation to the implementation of an economic order entitled in its current Constitution, making a parallel between the advent of the Brazilian Democratic State and the conceptual evolution of the ethical, economic and political elements that establish its fundamental principles, having as material support the jurisdictional activity that has as its decision-making north the ethical precepts aimed at achieving the social objectives prescribed in the 1988 Constitution of the Federative Republic of Brazil. Taking advantage of the hypothetical-deductive method of investigation, through a bibliographical and descriptive research, it is concluded that the intervention of the State on the economy has an ethical purpose in the task of converging conflicting individual and social interests.ptÉticaIntervenção econômicaConstitucionalismo
