Dissertação (Mestrado Profissional em Desenvolvimento Regional) - Centro Universitário Alves Faria, 2023. - ( Dissertação )https://repositorio.unialfa.com.br/handle/123456789/359This dissertation is part of the research line on Public Policies, Productive Arrangements (clusters), Territory, and Regional Development within the Professional Master's Program in Regional Development at Centro Universitário Alves Faria (UNIALFA). Its research problem revolves around the following inquiries: How can notaries of protests in Brazil contribute to improving access to justice in credit recovery, whether in cases of Active Debt Certificate (CDA) or civil execution, and ensure a fair legal order? And how can the specific actions of the Protest Notary Office in Caculé (BA) impact regional development? The general objective is to analyze the role of notaries of protests in access to justice in credit recovery, with a specific focus on the Protest Notary Office in Caculé (BA) and its impact on regional development. The specific objectives include: analyzing public policies related to credit recovery in Brazil and identifying the challenges faced by debtors and creditors in this process; investigating the role of notaries of protests in the credit recovery process, examining their functions, responsibilities, and the challenges they face in their performance; identifying best practices adopted by the Protest Notary Office in Caculé (BA) concerning credit recovery and how they can be replicated in other regions of the country; evaluating the impact of the actions of the Protest Notary Office in Caculé (BA) on dejudicialization and regional development, examining the economic and social effects, and proposing recommendations to enhance the role of notaries of protests in the credit recovery process and promote access to justice and a fair legal order in the country. The research is justified by the fact that access to a fair legal order, or access to justice, is one of the milestones of a country's development. In Brazil, there is an excessive judicialization of debts, leading to a high congestion rate. Therefore, the research aims to relate and quantify data on the dejudicialization process through the protest notary to assess its efficiency in credit recovery and regional development, providing supporting evidence for such claims. For theoretical support, the following works were used as references, among others: Araújo (2019); Cantídio (2022); Cappelletti and Garth (1998); Pinheiro (2009); Figueira Júnior (2019); Freitas and Vita (2017); Morais (2008); Ribeiro (2005); Santos (1999); Santos and Coutinho (2002); Sales (2004); Sen (1999); Watanabe (2011); Warat (2001). The research was conducted using a qualitative approach with exploratory and descriptive objectives. The procedures used included bibliographic and documentary research, questionnaire application, and conducting interviews. The conclusion drawn was that the dejudicialization process is an essential tool in achieving universal access to justice as a mechanism to deliver a prompt, secure, and effective service to users. The utilization of extrajudicial services, specifically protest notary offices, is already a reality, but it requires normative improvements to optimize the justice distribution system.ptDesjudicializaçãoTabelião de protestoCaculé (BA)A política pública de desjudicialização e o acesso à justiça célere por meio do tabelionato de protesto em Caculé (BA)
