Dissertação (Mestrado Profissional em Direito Constitucional Econômico) - Centro Universitário Alves Faria, 2026.https://repositorio.unialfa.com.br/handle/123456789/845This dissertation examined the phenomenon of dejudicialization within the Brazilian legal system, focusing on the consolidation of fiduciary ownership and the extrajudicial repossession of vehicles, introduced by Law No. 14,711/2023 and regulated by Provision No. 196/2025 of the National Council of Justice. The study investigated whether these procedures can broaden access to justice without compromising the parties’ constitutional safeguards and assessed their potential impact on the credit market. A qualitative, legal-dogmatic approach was adopted, using the deductive method and bibliographic and documentary research techniques, with an analysis of legal scholarship, legislation, regulatory acts, case law, and institutional documents related to the Judiciary, extrajudicial registry and notarial services, and the credit market. First, the evolution of the concept of access to justice and the Brazilian multi-door justice system was analyzed; next, dejudicialization was examined as a technique for organizing the justice system, together with the legal framework governing extrajudicial registry and notarial services; finally, the judicial and extrajudicial procedures for the consolidation of fiduciary ownership and the repossession of vehicles were compared, with particular attention to extrajudicial due process and the constitutionality of the model. The results indicated that dejudicialization can broaden the avenues available for dispute resolution without excluding state jurisdiction. Although the Federal Supreme Court recognized the constitutionality of these procedures in Direct Actions of Unconstitutionality Nos. 7600, 7601, and 7608, the study concluded that the legitimacy of the model depends on preserving adversarial proceedings, adequate information, the impartiality and independence of delegated agents, publicity, predictability, oversight, and timely judicial protection, while prohibiting forms of private coercion incompatible with fundamental rights and guarantees. From an economic perspective, the documents analyzed indicated the potential to reduce the risks and costs associated with the recovery of collateral, as well as possible favorable effects on credit. However, the available empirical data remain insufficient to establish an actual impact on interest rates or an expansion in the supply of financing. It was therefore concluded that the procedures examined constitute constitutionally legitimate instruments for reorganizing the multi-door justice system, provided that they are structured according to a rights-protective approach capable of reconciling efficiency, access to justice, and the protection of fundamental rights.ptDesjudicializaçãoAlienação fiduciáriaBusca e apreensão extrajudicialAcesso à justiçaO fenômeno da desjudicialização no Brasil e a consolidação de propriedade e busca e apreensão de veículos, pela via administrativa, como instrumentos de acesso à justiça e de potencial fomento ao crédito
