The general objective is to investigate how state regulation, from the perspective of the Federal Constitution of 1988, and CADE's decisions in concentration acts impact access to health, consumer rights, and economic development. The research problem focuses on the effectiveness of state regulation and the influence of CADE's decisions in preserving competition, service quality, and health plan prices. The methodology includes a literature review and qualitative analysis of CADE's counselors' votes (2018-2022). The results reveal the complexity of the sector, with challenges in reconciling consumer protection and competitive dynamics. ANS regulation seeks to balance quality and sustainability, while CADE assesses the impacts of mergers and acquisitions.
