The objective of this dissertation is, above all, to demonstrate the execution of the inspection, as well as the reversal of fines for the benefit of the environment. Environmental inspection is exercised by the police power, a formal responsibility of the public power, and must ensure the social interests arising from the determination of responsibility for damages caused and the consequent application of fines and administrative sanctions, in accordance with laws and normative acts, emanating from the powers and /or competent bodies. Although enacted Federal law regarding environmental policy, the ineffectiveness of the National Environmental Policy (PNMA) remained insufficient, only with the Federal Constitution, apex of the normative pyramid, presented the first milestones in favor of the environment. Divided into four chapters, this work will first address: environmental impacts and sustainable developmente, guiding principles of environmental law and the power of politics, exercised through control bodies; in addition, in the background, it analyzes the National Environmental Policy - PNMA with special attention to the forms of repression of environmental crimes, according to the modalities and requirements of the law; the methodological approach will be mixed, combining qalitative, quantitative and deductive elements to analyze the object of study; and, ultimately, investigates the reversal of a fine in favor of the environment and the function of the National Environmental Fund (FNMA).ptFiscalização AmbientalMulta AmbientalMeio ambienteDesenvolvimento sustentavel
