Dissertação (Mestrado Profissional em Direito Constitucional Econômico) - Centro Universitário Alves Farias, 2022.https://repositorio.unialfa.com.br/handle/123456789/206The present research aims to explore the evolution of Brazilian legislation on the subject of urban mobility to the conceptualization of electric bicycles and scooters, with the amendment introduced by Law n. 14.071/2020, in the Brazilian Traffic Code and Resolution n. 947/2021 of CONTRAN. I prepare a table to differentiate the active modes of regular, electric and moped by current legislation. I emphasize that the Municipality was assigned the regulation, promotion of circulation and areas of protection for cyclists, in art. 24, item II, of the CTB and that municipal legislation prepared for this purpose was declared unconstitutional. I pointed out the lack of general Brazilian legislation on the shared service of bicycles and scooters, regular or motorized, and that public policies for the provision of the service, as well as actions by state agencies and private companies to promote active modes are inefficient. I looked in foreign law, specifically in the city of Bogotá, Colombia and Buenos Aires, Argentina, for a model of measures implemented that made them a cycling city. I search for the importance of actions by public agencies and private companies as promoters of cyclomobility. I analyze the Brazilian reality about mobility by bicycles and scooters and the shared service of these modes, with the aim of enabling the regulation. For that, I make use of the exploratory deductive method, comparative research of a bibliographic nature, including in comparative law to make a current analysis and the challenges of Brazil on the subject.ptMicromobilidade urbana por modais ativosRegulação do serviço compartilhado de bicicletas e patinetesRegulares elétricosA regulação do serviço compartilhado de bicicleta e patinetes regulares/elétricos e os desafios da micromobilidade urbana no Brasil
