It departs from the premise that the 1988 Federal Constitution establishes economic foundations that guide the Brazilian legal order, particularly with respect to free enterprise, the valorization of labor, and the social function of the company. In this context, judicial reorganization is analyzed not merely as a procedural instrument provided for in Law No. 11,101/2005, but rather in light of its potential economic impact resulting from its application—especially in cases of successful reorganization that ensure the preservation of jobs, tax collection, and the circulation of wealth. The dissertation further investigates the effectiveness of this legal mechanism in relation to the constitutional principles of the economic order, as well as the broader socioeconomic impacts of its implementation in the Brazilian context. For this purpose, the bibliographic method was employed. In conclusion, judicial reorganization must be understood as an expression of economic constitutionalism, integrating the normative system aimed at ensuring stability and the development of productive activity. This study contributes to a deeper understanding of the role of law in overcoming economic and financial crises faced by entrepreneurs and business corporations, reinforcing the importance of a constitutional and doctrinal approach in the interpretation and application of reorganization law.ptRecuperação judicialDesenvolvimento econômicoAtividade empresarial
