A viabilidade Jurídico-constitucional do capitalismo humanista: A partir da função social da empresa no Brasil. Goiânia (GO), 2025. 82 f. Dissertação (Mestrado Profissional em Direito Constitucional Econômico) - Centro Universitário Alves Faria, 2025.https://repositorio.unialfa.com.br/handle/123456789/700This study examines the new responsibilities assigned to Brazilian notaries under Ar- ticle 7A of Law No. 8,935/1994, introduced by Law No. 14,711/2023, in the context of CNJ's Goal 9/21, which aims to promote the dejudicialization of conflicts by 2030. The central research ques- tion is: “What are the social, legal, and economic impacts of the new notarial duties, especially in relation to state cost-effectiveness and business development?” The general objective is to criti- cally analyze the implications of notarial certification of contractual conditions, mediation, con- ciliation, and arbitration in Brazil’s legal and economic systems. Specific objectives include: (i) assessing the impact of notarial certification on legal certainty; (ii) examining how mediation and conciliation promote social peace; and (iii) analyzing the potential of notarial arbitration as a tool to foster the business environment. The theoretical foundation is grounded in the Economic Con- stitutional Law, articulating the principles of state cost-efficiency, administrative effectiveness, and access to justice with the normative transformations brought by the expansion of notarial func- tions. The research adopts a qualitative, exploratory, and theoretical-normative approach, with lit- erature review and critical analysis of the current legal and jurisprudential framework. Empirical insights are drawn from the implementation of Law No. 11,441/2007, which illustrates the effec- tiveness of extrajudicial practices in reducing judicial burden and generating substantial savings for the public administration. Findings suggest that these expanded notarial functions significantly contribute to institutional modernization, legal system streamlining, and the promotion of a more dynamic business environment. Notarial certification of contractual conditions strengthens legal certainty by validating formal agreements and preventing litigation. Mediation and conciliation offer faster and less burdensome alternatives for conflict resolution, while arbitration provides a binding, effective solution for complex disputes—especially relevant in business and real estate sectors. The study also reveals social impacts such as the strengthening of a multi-door justice sys- tem, the enhancement of notarial services as agents of social peace and inclusion, and the redefini- tion of notaries as public governance facilitators. Ultimately, the research contributes to the ad- vancement of national judicial policy by proposing a critical review of the current regulatory framework and recommending its improvement to institutionalize these functions as part of a more accessible, efficient, and development-oriented model of justice.ptTabelião de notasFomento empresarialDesjudicializaçãoRegulação econômicaAs funções ampliadas conferidas aos notários e seus efeitos sociais : o art. 7-a da lei nº 8.935/1994 análises e desdobramentos no direito constitucional econômico
