Dissertação (Mestrado Profissional em Direito Constitucional Econômico) - Centro Universitário Alves Faria, 2025.https://repositorio.unialfa.com.br/handle/123456789/711The judicialization of health has become one of the greatest challenges for the Brazilian State, especially regarding the distribution of competences and budgetary impacts to municipalities, as seen in the context of Goiânia. The research, from the perspective of Economic Constitutional Law, aims to answer the following problem: How the establishment of judicial competence, signed by the Supreme Court in Theme 1.234, has contributed to a more balanced and efficient municipal health management, and what are the legal, administrative and budgetary impacts on public health policies? The objective of this dissertation is to analyze the legal, administrative and budgetary reflexes of the establishment of the judicial competence of health demands, signed by the Supreme Court in Theme 1.234, assessing its contribution to a more balanced and efficient municipal health management and verifying the effectiveness of the mechanisms implemented in municipal health management, having as reference the city of Goiânia. We adopted a qualitative approach, with deductive method, based on bibliographical and documentary research (doctrines, legislation, and judicial precedents) complemented by case study of the city of Goiânia, with data analysis on legal actions and budgetary impacts. The results show that the decision regarding Theme 1.234 of the STF marks a significant point by establishing objective criteria of competence and federal responsibility in the search for more effective and legally safe economic regulation in the health sector. However, this achievement is still not enough to solve the financial and administrative imbalances that mark the federal system of Brazil. The analysis reveals that finding a balance between the right to health and fiscal responsibility requires not only fair judicial decisions, but also well-structured public policies, planning involving diverse levels of government and local capacity building. Thus, by defining the judicial jurisdiction over health claims, the Supreme Court, in the judgment of Topic 1.234, reaffirms the role of the Judiciary in the protection of fundamental rights, but also establishes concrete mechanisms aimed at promoting greater rationality and legal certainty in the processing of these actions. It examines the effectiveness of the mechanisms provided by the STF - as objective criteria of competence based on the annual cost of treatment and the regulatory situation of the drug before Anvisa - and the incentive to technical cooperation between federal entities and the judiciary itself. The dissertation analyzes to what extent these instruments have been effectively implemented in municipal administrative and budgetary practice, especially in the case of Goiânia, showing that the effectiveness of economic regulation in the right to health depends not only on the judicial decision, the coordinated adoption of these mechanisms, the strengthening of local public governance, federal solidarity and shared responsibility among all levels of the Federation.ptDireito a saúdeGestão municipalSupremo Tribunal Federal (STF)Regulação econômica da saúde no município de Goiânia e o tema 1.234 do STF : impactos jurídicos, administrativos e orçamentários sob perspectiva do direito constitucional econômico.
