Goiânia (GO), 2024. 93 f.https://repositorio.unialfa.com.br/handle/123456789/418The scope of this work is the analysis of urban land regularization as an instrument of materialization of the principle of the social function of property in the constitutional economic order, starting from the study of the right to property and its historical evolution from the Empire Constitution of 1824 to the Federal Constitution of 1988, its social function and the right to housing associated with the principles and the case study of the REURB program of the municipality of Barra do Sul. Herons-MT. From this point of view, the irregular occupation of urban land is a phenomenon presented in most Brazilian cities and consists of precarious settlement, on the margins of regulatory frameworks, with non-observance of minimum infrastructure standards. Land Regularization presents the consecration of possession as an exercise of the social function of property, which is the basic element for the constitutional guarantee of the right to property, based on a set of legal-registry, urbanistic, and social measures and environmental problems, aimed at solving this problem. The institute of land regularization and its modalities will be technically demonstrated and presented as an effective instrument in addressing this issue, based on the legislation in force, such as Federal Law No. 13,865/2017, and on authors such as GRAU, COMPARATO, BERCOVICI, DEMETRIOS, PAIVA, TAVARES, among others.ptOrdem econômicaConstituição EconômicaFunção social da Propriedade
