A reserva do possível e o adequado de medicamentos de alto custo pelo Sistema Único de Saúde (SUS): uma análise a partir da Constituição Econômica Brasileira. Goiânia (GO), 2025. 99 f Dissertação (Mestrado Profissional em Direito Constitucional Econômico) - Centro Universitário Alves Faria, 2025.https://repositorio.unialfa.com.br/handle/123456789/619The dissertation analyzes the Federal Constitution from the perspective of the "Economic Constitution," with an emphasis on the fundamental principle of human dignity, the fundamental social right to health, and its realization through social justice, starting from the caput of article 170. It aims to examine the relationship between the principle of the reserve of the possible and the provision of high-cost medications by the Unified Health System (SUS), considering the current jurisprudence of the Federal Supreme Court (STF) and its impact on the decisions of the Court of Justice of the State of Goiás (TJGO) and the Federal Regional Court of the 1st Region (TRF1). The research progresses from a bibliographic review, document analysis, jurisprudential comparison, and case study, using the hypothetical deductive method. It discusses the principle of the reserve of the possible, its factual and legal dimensions, its mitigation through the protection of the essential core of fundamental rights, the guarantee of the existential minimum, the prohibition of social regression, and the principles of proportionality and reasonableness, highlighting, in cases of insufficient public health policies, the prominent role of the Judiciary in the realization of social rights. It addresses the pharmaceutical assistance of the Unified Health System (SUS), describing the structure of funding and the roles of the Union, States, Federal District, and Municipalities. It studies the high-cost medications provided by SUS. It highlights the budget and public health expenses, according to the Public Health Budget Information System (SIOPS), presenting the example of the Union and the State of Goiás, alongside the panel of health judicialization, made available by the National Judicial Data Base (DATAJUD). Finally, it describes the theses that substantiated Issues No. 6 and No. 1234, Federal Supreme Court, based on the dialogue between social justice and the principle of the reserve of the possible and presents the prior jurisprudence of TRF1 and TJGO, anticipating points of agreement and disagreement, in order to predict the ease or difficulty in adhering to binding precedents.ptSistema Único de SaúdeReserva do possívelPrincípios constitucionaisConstituição econômicaA reserva do possível e o fornecimento de medicamentos de alto custo pelo Sistema Único de Saúde (SUS): uma análise a partir da Constituição Econômica Brasileira
