The objective of the Economic Order is to guarantee everyone a life of dignity, valuing the human condition, in accordance with the principles of social justice. Within the competitive landscape, the State begins to emphasize its role as regulator, resulting in an increased importance of the Administrative Council for Economic Defense (CADE). The study focused on answering the following question: How does CADE proceed in preserving competition and market efficiency in relation to health plan mergers that affect consumer welfare? The study's general objective was to analyze the mergers of health plan mergers within CADE and their relationship to consumer welfare. To achieve these objectives, this study conducted bibliographical research with a qualitative and documentary approach, using the hypotheticaldeductive and dialectical methods. The study included an analysis of laws, regulations, and various texts by recognized scholars, as well as an analysis of the 1988 Federal Constitution (CF/88) regarding competition protection and the well-being of Brazilian consumers. CADE's actions can be divided into two areas: repressive, which combats anticompetitive practices stipulated in articles 20 and 21, and preventive, which refers to acts of concentration, as per article 54, paragraph 3. It is unacceptable for competition to occur in a way that harms job creation, the quality of products and services offered to consumers, among other aspects. The analysis of the economic properties of the supplementary healthcare market marks significant progress in CADE's stance regarding this sector. However, these changes still have limited impact and are far from ideal, since patient well-being is rarely addressed in the antitrust authority's deliberations.ptDireito do ConsumidorPlanos de SaúdeConselho Administrativo de Defesa Econômica (CADE)Constituição Federal de 1988Análise dos atos de concentração dos planos de saúde : na perspectiva do direito econômico e do bem-estar do consumidor
