O princípio da cooperação e o gerenciamento processual como instrumentos na busca pela razoável duração do processo: análise dos deveres das partes e do juiz. 2023. 112 f. Dissertação (Mestrado em Função Social do Direito) – Faculdade Autônoma de Direito, São Paulo, 2023.https://repositorio.unialfa.com.br/handle/123456789/504This study deals with the reasonable duration of the process, a guarantee expressly provided for in the Federal Constitution, as the responsibility of those who participate in the process, especially the parties and the magistrate. The work was divided into four chapters. The first deals with the reasonable duration of the process, addressing that the unjustified delay in the procedural process is an obstacle to access to justice, which is achieved when a fair decision is obtained, in a reasonable time and in compliance with procedural principles. The second chapter deals with procedural cooperation, addressing the cooperative model of the process. The principle of cooperation, set forth in the Code of Civil Procedure, establishes that all procedural subjects contribute to the formation of a fair, effective and timely judicial decision on the merits. However, as the decision is an exclusive function of the magistrate, when deciding, the judge assumes an unequal position in relation to the parties. Although the parties have different interests, this does not prevent them from acting with loyalty and good faith and this is what is expected of the parties in the cooperative model. In the third chapter, procedural management is analyzed, an important instrument to achieve a reasonable duration of the process. The magistrate can adapt the case according to its complexity, acting as the manager of the process. Among the procedural management techniques that can collaborate so that the process proceeds in a reasonable time, it is possible to mention the procedural business, the procedural schedule, the establishment of a chronological order in the judgment, the sanitation, among others. Finally, in the last chapter, the relationship between the cooperation of the parties and the magistrate and the duration of the process is considered, concluding that the parties are expected to act ethically, without unnecessary interventions and that they do not adopt a contradictory behavior; the magistrate, on the other hand, has duties of clarification, consultation, prevention and assistance. In this way, the process will proceed with all procedural subjects in pursuit of the same purpose, that is, a judicial decision on the merits, fair, effective and in a reasonable time.ptPrincípio da cooperaçãoGerenciamento processualDeveres das partesDeveres do juizO princípio da cooperação e o gerenciamento processual como instrumentos na busca pela razoável duração do processo: análise dos deveres das partes e do juiz.
