Dissertação (Mestrado Profissional em Direito Constitucional Econômico) - Centro Universitário Alves Faria, 2026.https://repositorio.unialfa.com.br/handle/123456789/846This dissertation analyzes the legal institute of estremação as an extrajudicial mechanism for individualizing consolidated fractions in general pro diviso co ownership, with particular attention to the rules issued by the Internal Affairs Office of the Court of Justice of the State of Goiás in the Code of Rules and Procedures of the Extrajudicial Forum, as amended by Administrative Order No. 136/2024, which extended the institute to urban properties. It starts from the problem of Brazilian land informality, in which millions of localized and long-standing possessions remain legally undivided in the common title record, reducing property value, hindering access to credit and perpetuating disputes. The research investigates how the institute incorporates and operationalizes the constitutional principles of the social function of property, legal certainty and access to justice in the regularization of localized fractions. It adopts a qualitative approach, a deductive method and bibliographic and documentary research, with a comparative analysis of state regulations and an article by-article examination of the Goiás rules. The results indicate that the institute, especially in its Goiás form, is compatible with the constitutional foundations of the economic order, capable of converting consolidated possessions into full ownership, with public faith equivalent to the judicial route, significantly lower cost and greater speed, and that the extension of the procedure to urban properties projects the effects of the social function of property from the countryside to the city, subject to the material limits of rural and urban land subdivision and the safeguards of the extrajudicial adversarial process.
