The observance of such priority, provided for in art. 36 of the National Solid Waste Policy Law (Law No. 12,305 / 10), is essential for the socio-productive inclusion of waste pickers, but it is a legal rule of little effectiveness, as can be seen from surveys of statistical data sources. Thus, through the analysis of these data and bibliographical research, it was sought to investigate the factual and legal problems that impede the effective realization of the priority in question, and, in general, the social inclusion of the collectors. First, it was necessary to contextualize the problem of waste generation, as well as to explain in a certain depth about the norms integrating the Law of the Waste in Brazil, and also to dispose about the benefits of the recycling and give a brief exposition about the history of the activities of the collectors in the country, as well as on its forms of organization. It was pointed out that, more than legal deficiencies, Brazilian society presents a serious lack of socio-environmental awareness and solidarity. In order to try to change this framework, it was revealed that Law has much to contribute, especially with regard to the implementation of public policies related to the subject, and the application of economic instruments such as Payment for Urban Environmental Services directed to the collectors. In addition, it was concluded that there is a need to improve Environmental Education policies, applying a critical approach coupled with the notion of spirituality, as well as stimulating solidarity economy and reflecting on the feeling of solidarity. All these forms of thought and action should permeate the activities of the branches of government, institutions and control bodies and civil associations concerned, so that it can obtain not only the effective socio productive inclusion of the collectors but also, in the long term, the possible displacement of these workers to other activities, as long as the minimum generation of waste is achieved.ptDesenvolvimento econômicoSustentabilidadePolítica Nacional de Resíduos SólidosInclusão socioprodutiva
