The first and second chapters are dedicated to searching for the origins of the institute of remission through work and study, which occurred in Spain (remission through work) and France and Spain (remission through study), mainly through the analysis of legal provisions of the time, but also through a literature review on the subject. In the first and second chapters, a history of the introduction of these institutes in Brazil was made. The third chapter is dedicated to rescue the introduction of libraries in prisons and their current situation in the prison system. Also in this chapter, a survey is made of all the regulations on the theme of the remission of reading, pointing out its limits and contradictions and analyzing its purposes and foundations using as parameters documents produced by segments of the UN, the Ministries of Justice and Education and specialized institutions. Finally, the last chapter discusses the role of the judicialization of the penal execution as a way to ensure the preservation of fundamental rights of prisoners, points out possible ways to accomplish the remission of time in general and the remission of time in particular, proposes a new legal basis, other purposes, more appropriate grounds, based mainly on Antonio Candido and his understanding of literature as a human right.
