It is based on the premise that consumer protection, elevated by the 1988 Federal Constitution to the status of a fundamental right and a principle of the economic order, is not limited to its normative dimension, but depends on the existence of effective and timely judicial protection for its realization. The research adopts a predominantly bibliographical approach, supported by jurisprudential analysis and empirical data derived from the “Justice in Numbers” reports issued by the National Council of Justice. Initially, the study examines the incorporation of consumer protection into the Economic Constitution, highlighting its structuring role in shaping the market and promoting balance in consumer relations. It then analyzes the principle of the reasonable duration of proceedings, its constitutional foundations, criteria for assessment, and its repercussions on economic activity, emphasizing that judicial efficiency is a relevant factor for legal certainty, institutional trust, and economic development. In this context, the study engages with international governance parameters, particularly the United Nations 2030 Agenda, with emphasis on Sustainable Development Goal 16, which advocates the promotion of effective, accountable, and inclusive institutions. This guideline demonstrates that the efficiency of the justice system is not limited to the procedural dimension but constitutes an essential requirement for the realization of fundamental rights and for the proper functioning of the economic order. Subsequently, the dissertation analyzes the main legal and structural challenges related to procedural delay in consumer disputes, with emphasis on mass litigation, the role of repeat players, evidentiary difficulties, and, above all, the inefficiency of the enforcement phase, identified as the main bottleneck of the justice system. Empirical data reveal the existence of a structural paradox, whereby the system shows a greater capacity to recognize rights than to enforce them, exposing a profound asymmetry between the adjudicative and enforcement stages. It is concluded that procedural delay undermines not only the effectiveness of consumer rights but also the economic order itself, by increasing transaction costs, expanding legal risks, and reducing the predictability of market relations.
