In this context, de facto Economic Groups are included, understood as that group of companies that, despite not being duly adjusted to the legal terms of constitution of a Law Economic Group, end up acting in a coordinating manner, with an economic objective common. The reality in which they are inserted, outside a context of constitutive legality, causes several problems of a material and procedural order to be established. Based on this issue, we will seek to obtain reliable parameters that allow its characterization and identification in the analysis of specific cases.
