The case of the ChatGPT robot is used in this study as an example of a high-profile data leak, which demonstrates the vulnerability to which consumers are subjected. Therefore, consumer data is at risk and must be protected in keeping with the fundamental human right to privacy. The objective of this study is to show the need to create this policy of preventive rules for the protection of the aforementioned data, so that the constitutional principle of the economic order of consumer protection is guaranteed. Our hypothesis is that it is urgent to create a policy of preventive rules for the protection of consumers' digital personal data, reducing the risks of inadequate and illegal treatment of citizens' personal information, such as data leaks, mitigating the consequences negative effects that artificial intelligences, in this regard, can cause society as a whole and specifically consumer relations.
