The research question asks: Is the regulation established by Law 14.790/2023 adequate to simultaneously ensure the formalization of the online betting market, the protection of fundamental consumer rights, and the legal certainty required by the constitutional economic order? To answer this question, we examined the theoretical foundations of economic regulation, the role of legal certainty, the social and economic impacts of online betting, and international models for regulating the activity. Methodologically, we adopted a qualitative and legal-dogmatic approach, with documentary analysis and a bibliographic review of classic authors in Economic Analysis of Law, such as Coase, Posner, Calabresi, and Becker, as well as constitutional scholars such as Canotilho and Grau. We also analyzed regulatory models in countries such as the United Kingdom, Italy, Spain, Malta, and the United States, seeking to identify best practices and comparative weaknesses. The results demonstrate that Law 14.790/2023 represents progress by establishing minimum standards for formalization, taxation, and oversight, but it still reveals weaknesses in preventing gambling addiction, protecting vulnerable groups, and ensuring the effectiveness of government action. It was observed that the Brazilian model tends to prioritize revenue collection over mitigating social costs, which can compromise the legitimacy of public policy and create risks of regulatory regression. The conclusion is that the new legal framework constitutes an important starting point for regulating online gambling, but it does not conclude the regulatory process. Its continuous review and improvement are necessary, with a focus on institutional strengthening, protecting fundamental rights, and building a stable and efficient regulatory environment capable of balancing economic freedom, social justice, and legal certainty, in line with the principles of the 1988 Federal Constitution.ptRegulação econômicaApostas onlineSegurança jurídica
