The Federal Constitution of 1988 brought in its essence several principles that seek to protect the fundamental rights of the human being. Among them is the principle of full employment, which is a vector of the economic and social order, provided by the art. 170, VIII of the Magna Carta. Thus, the present work aims to analyze some important theoretical concepts about the theory of full employment elaborated by John Maynard Keynes and to relate it with the Brazilian constitutional principle, considering that the Keynesian economic theory was a historical landmark of great proportion concerning the pursuit and appreciation of full employment, and has not been studied in a more specific way today. The purpose of this research is to understand the debate on the theoretical economic and legal concepts about full employment in the Federal Constitution of 1988, evaluating some notes on the subject according to the theory of social welfare. This foundation goes beyond the notion of submission to legality, so that it seeks to achieve material equality and social justice. This is bibliographical research, with a theoretical aspect and a qualitative approach, which seeks a dialogue between the constitutional principle of seeking full employment in the Constitution and Amartya Sen's theoretical conceptions regarding development and freedom. In the conception of Amartya Sen, he pursues an interpretation for the principle of full employment, relating it to economic and human development, in a perspective of the realization of human rights. Therefore, we can conclude that development policies should deal with the notion of freedom and its interconnections, so that economic growth enables the State to finance social programs through the expansion of services and a search for effectively valued labor.ptPrincipio do plano empregoConstituição econômicoDesenvolvimento econômico
