It discusses the possibility of coexistence between individual protection and systemic security, paying attention to the economic implications of judicial decisions. It describes the most recurrent types of fraud; analyzes the civil liability of banks, examining the consumer's exclusive fault as a possible exclusion of liability; and evaluates the normative initiatives and security mechanisms implemented by the institutions, exploring their impact on the economy and the safeguarding of users. The methodology used is qualitative, based on bibliographic study and document analysis. The conclusion points out that bank fraud is not limited to generating immediate financial losses, but also has effects on collective trust, institutional governance mechanisms, and the very functioning of the economic system. The civil liability of institutions, the implementation of adaptive security systems, and prudential regulation constitute interconnected elements that, when integrated with standards of transparency, effective governance, and robust operational practices, simultaneously ensure user protection and the soundness of the financial system, offering graduated responses to the complexities of the contemporary world and the demands of an increasingly connected, vigilant, and risk-sensitive society.ptResponsabilizaçãoFraudes bancáriasProteção ao consumidorEstabilidade econômica
