The objective is to debate the role of transport companies by application in contributing to the mobility of people with disabilities based on the Economic Constitutional Law, in order to stimulate academic debate on the issue and to point out possible solutions to improve the provision of this service for people with disabilities. To achieve the objectives, as well as to develop a broader and deeper understanding of the issue, the research is divided into four parts: i) historical aspects of the exclusion of people with disabilities; ii) evolution of legislation pertaining to people with disabilities; iii) considerations on collaborative consumption and sharing economy in current times and also on regulatory challenges associated with this economic model; and iv) constitutionality of business promotion of accessibility by private companies. Bibliographical and documentary sources, videos with expert reports, federal and municipal laws, scientific articles in magazines and specialized periodicals were used in the construction of this academic writing. The reflections provided by the execution of this work allow us to conclude that, under the legal aspect, the Statute of the Person with Disability represents a great advance for the inclusion of the person with disability in society. Regarding transportation apps, they can be important partners in the inclusion process, although there are important regulatory challenges to be faced and overcome in the sharing economy model. As a result of these reflections, it is inferred that it is a constitutional obligation that the apps have accessible cars for people with disabilities.
