Dissertação (Mestrado em Função Social do Direito) – Faculdade Autônoma de Direito, São Paulo, 2023.http://repositorio.unialfa.com.br/handle/123456789/509The presente work defends the central idea that artificial intelligence ia na importante tool for enhancing access to justice. It takes as its strating point the fascination that understanding about intelligence has generated in humanity, from ancient greek times to the preente day. The idea of building a machine that could reproduce human skills was the engine that propelled mankind to great inventions until the development of the technology that today comes closest to human intelligence, called intelligence. As a result of the increase in AI, some jobs are already seeing the substitution of man by machine, in a similar movement observed during the Industrial Revolution. However, new functions tend to emerge, privileging naturally human competencies, representing a natural realignment in search of the social balance altered by the new technology. To avoid the increase of people without jobs due to the advance of machines in the workplace, it is imperative to invest massively in people, training and preparing them for this new moment that leis ahead. In order to face it, a profound change must occur in the social environment. In this contexto, education will play an important role. The improvement of IA in the various sectors of the economy will require that qualified people, trained to deal with this technology, be avalilable to the market and to society, because only with qualification will it be possible to achieve the desired social balance. In the judicial sphere, artificial intelligence has been used to combat the invincible number of lawsuits, the result of the propagated culture of litigation and stimulated by unlimited access to justice, in a mistaken vision of the principle of the unassailable jurisdiction. With the Covid-19 Pandemic, the use of IA has increased and expanded, proving to be a necessary tool for the improvement of the quality of judicia services. Under the coordination of CNJ several projects are being developed in the courts of the country aiming to build artificial intelligence tools that will help in the management of daily activities and demands. The use of artificial intelligence by the Judiciary, however, desserves caution to prevent the fundamental rights that are duly assured from being violated by the indiscriminate use of technology. In this context, the regulation of its use through the elaboration of a special law is necessary to guarantee the security of the digital environment, transparency and opposition to the results, as well as the due auditability of the entire system. The ethics in algorithm systems is fundamental for their adoption to occur on a secure basis, expanding access to justice. The addition of artificial intelligence to conflict resolution methods has the potential to transform the culture of litigation into a culture of consensus, given the results achieved by the projects in execution. Moreover, online conflict resolution methods also allow disputes to be resolved in na agile and simplified manner, without the presence of a magistrate. Expanding the forms of conflict resolution allows citizens to choose the best and most appropriate way to resolve the conflict, making it the protagonista in the exercise of the right to have access to justice.ptInteligência artificialAcesso à justiçaSolução de conflitosO uso da Inteligência Artificial para o aprimoramento do acesso à justiça
