Dissertação (Mestrado em Função Social do Direito) – Faculdade Autônoma de Direito, São Paulo, 2024.http://repositorio.unialfa.com.br/handle/123456789/557This dissertation aims to present a critical analysis of the classification of feminicide in the context of domestic violence in Brazil and the impact of Laws No. 13,104/2015 and No. 14,994/2024 on the number of occurrences. To this end, the contextualization of gender violence is exposed and national and international instruments that provide for women's rights are cited; justifications for the creation of the feminicide qualifier are presented; the justifications and evolution of the concept of feminicide are researched; the discussion on the divergence that existed regarding the legal nature of the qualifier is covered; and the analysis of Law No. 14,994/2024, recently approved and which makes feminicide an autonomous crime, is analyzed. Regarding the methodology, the research method used was deductive, operationalized through bibliographic research carried out in books and articles referring to violence against women and the maximum manifestation of this violence, feminicide, in addition to documentary research being carried out in legislation and cases that could illustrate the theme addressed. At the end of the study, it became clear that, although the changes proved to be relevant in establishing a new perspective on gender-based violence, the creation of the Femicide qualifier was not fully effective in containing cases for complex and interconnected reasons, which certainly generated new discussions and proposals for legislative changes or additions. Considering that in 2023, Brazil registered 1,463 cases of femicide, which represents a rate of 1.4 women killed for every 100,000, in order to give effect to the provisions of the Maria da Penha Law and international conventions on women's rights and on containing violence against them perpetrated in the most diverse forms and in a repeated manner, notably in the Pará Convention and the Beijing Treaty, Law No. 14,994 was sanctioned on October 10 of this year, 2024, which made femicide an autonomous crime and aggravated its penalty, in an attempt to overcome the persistence of structural machismo still present in our society, from which a large number of underreporting. It cannot be ignored, also, that in order to make the Law effective and efficient, a broad and integrated approach to the problem is necessary, with coordinated efforts between the government, civil society and justice institutions, with a view to promoting cultural changes, addressing the problem and creating a broader and more credible support network, capable of offering greater security and protection to victims, from their arrival at the police station until the delivery of the judicial service in a faster manner and without revictimization.ptViolência contra a mulherFeminicídioLei 13.104/2015Lei 14.994/2024A tipificação do feminicídio no contexto da violência doméstica no Brasil: uma análise crítica
