Therefore, it exposes the social aspects of the Brazilian economic constitution, emphasizing the emptying of the constitutional content and the trivialization of social demands; clarifies the relationship between social spending and economic growth; and discusses the effects and consequences of judicial interventions on social spending. With regard to the methodology adopted in this study, a survey was carried out in legislation, jurisprudential understandings and doctrines, notably in the areas of power theory, fundamental rights, public policies, public spending and public health. At the end of the study, it was concluded that issues related to financial capacity should be highlighted, whether in the public or private sphere of the provision of services, knowing that, given the scarcity of resources, it is not possible to safeguard any provision required. Therefore, it is demanded that certain choices be made based on the real needs of society. It should be noted that the right to health is a social right guaranteed by the Federal Constitution of 1988, so that this guarantee should not be judged from an individual perspective. Therefore, the use of class actions to ensure this right presents itself as the ideal legal mechanism.
