From this perspective, it was proposed to verify the effects of public health policies in the face of the growing search for the Brazilian Judiciary to enforce the fundamental rights guaranteed by the Constitution of 1988, taking into account the constitutional economic order for its execution. The Federal Constitution of 1988 is an important milestone for the formalization and realization of public policies, since it guarantees the right to health and the dignity of the human person. The dissertation allows us to consider that the judicialization of health should always stick to limits and criteria for its concession or denial, taking into account the protagonism and activism of the Judiciary in its function of protecting the fundamental rights to health. In addition, it was observed that the realization of the right to health by the Judiciary plays an important role in the realization of the constitutional economic order, considering that it fulfills the foundation exposed in article 170 of the Federal Constitution. The methodology used was bibliographical research and preliminary analysis on the central theme of this dissertation. Thus, it is possible to conclude that the existing public policies that enable access to health should be reviewed in order to meet the health of the Brazilian citizen, seeking balance among all three powers - Executive, Judiciary and Legislative - for their creation, execution and constant surveillance. The right to health must be guaranteed in a comprehensive and universal way, in order to ensure the dignity of the human person, and there must be equity and balance between the entire legal and political system of the Brazilian State, considering that the realization of the right to health is an important instrument for the realization of human dignity.ptDireito à saúdediálogo institucionalOrdem econômica constitucional
