Although the Incident of Disregard of Legal Personality (IDLP) has been widely discussed from a procedural perspective, especially after its regulation by Articles 133 to 137 of the 2015 Code of Civil Procedure, there remains a lack of studies that explore its theoretical foundations in light of the constitutional economic order and the legal-economic philosophy of humanist capitalism. This gap is relevant because the institute, by allowing the lifting of corporate autonomy in cases of abuse, serves as a means of protecting constitutional values such as human dignity, social justice, the social function of the company, and free enterprise, as established in Article 170 of the 1988 Federal Constitution. Therefore, this investigation is justified by the need to contribute to a systematic and constitutionally oriented interpretation of the institute, reconciling legitimate economic interests with the pursuit of social justice. The methodology adopted is qualitative, exploratory, and documentary in nature, based on bibliographic, normative, and jurisprudential analysis. The results indicate that the IDLP, when applied in accordance with the principles of humanist capitalism and the constitutional economic order, constitutes an effective mechanism for promoting social justice and economic sustainability by balancing legal certainty, corporate responsibility, and the protection of fundamental rights. It is concluded that the IDLP serves as a vector for the realization of constitutional principles and for balancing economic freedom, human dignity, and social justice, provided its application preserves procedural guarantees and prevents distortions that may hinder productive activity.ptCapitalismo humanistaDesconsideração da personalidade jurídicaSustentabilidade econômica
