Currently, it is possible to exploit human labor through technological mechanisms that dilute labor relations under the false argument of using a new economic system: the sharing economy. The general objective of this work is to analyze how the sharing economy in harmony with neoliberalism, due to the way it is applied, leads to the precariousness of labor relations by making the application of labor rights unfeasible. Specific objectives are to demonstrate the evolution of the exploitation of human labor within the industrial context to algorithmic subordination. Uber is the best-known digital platform for urban transport in the category that calls itself a technology company acting only as an intermediary between users and service providers. This argument, gradually, has been overthrown by foreign and domestic courts, despite the great divergence of understandings and little study material. The legal relevance of the subject is justified considering that it is a topic that still needs a lot of debate, there is a shortage of national legislative sources and the jurisprudential understanding is far from being pacified.
