The study, therefore, was structured from a literary review of doctrinal works, theses, dissertations and relevant scientific articles to the theme with a focus on the right to adequate food and the use of pesticides from the point of view of the Principles of Economic Constitutional Law. As a theoretical framework, the work of Ulrich Beck, Risk Society, was used, notably, Chapter I, entitled: On the logic of wealth distribution and risk distribution, in which he argues that the social production of wealth, in late modernity, is accompanied by the social production of risks. There is no doubt about the risks that pesticides can cause to public health and the environment. However, despite its recognized harmfulness, which would even justify its gradual prohibition, it was found that there was an increase in the number of pesticides released and used. In view of this, the role of the Brazilian Judiciary was addressed, through the investigation of Supreme Federal Court judgments, seeking to identify the position of this Court in the protection of the right to adequate food.ptSociedade de riscoAlimentação AdequadaAgrotóxico
