Dissertação (Mestrado Profissional em Direito Constitucional Econômico) - Centro Universitário Alves Faria, 2025.http://repositorio.unialfa.com.br/handle/123456789/660This study aims to critically analyze the current model of revenue management from the Financial Compensation for the Exploitation of Mineral Resources (CFEM), in light of Economic Constitutional Law, focusing on its budgetary non-allocation and the impacts on Brazilian mining municipalities. The specific objectives include examining the constitutional foundations of the economic order, studying the legal nature of CFEM, identifying the socio-economic and environmental impacts of mining, evaluating the allocation of resources in municipalities, and formulating proposals for a more efficient and sustainable management model. The methodology adopted was qualitative, using a descriptive method and deductive reasoning, with bibliographic and documentary research as the main technique. Divided into three chapters, in addition to the introduction and conclusion, the work initially addresses the constitutional foundations of the economic order and their application to mining, highlighting the social and environmental function of subsoil exploitation. It then reconstructs the normative trajectory of the CFEM and analyzes the limits and possibilities of non-earmarked revenues. In the second chapter, it examines the socioeconomic and environmental impacts of mining on municipalities, as well as evaluating the practical allocation of CFEM resources, highlighting challenges and examples of (in)efficiency. Furthermore, it discusses public policies and planning aimed at mitigating impacts and preparing for the post-mining period. Finally, the fourth chapter analyzes the risks arising from the depletion of reserves and lessons from recent disasters, while also proposing revisions to the CFEM legal framework, advocating for partial earmarking focused on sustainability and distributive justice. The study found that the non-allocation of CFEM revenues weakens the mitigation of mining impacts, perpetuates local economic dependence, and undermines the social function of economic activity. It is concluded, therefore, that the partial allocation of these resources is a viable alternative to promote economic diversification and regional distributive justice, in accordance with constitutional principles.ptExploração de recursos mineraisJustiça distributivaDesvinculação orçamentáriaCompensação financeira
