This study examines the implications of this phenomenon and its relationship with the debate on development, focusing on the allocation of public resources and access to healthcare, taking the State of Goiás as an empirical case and considering its repercussions for intergovernmental governance and territorial equity. The specific objectives are to analyze health judicialization in light of the Brazilian constitutional and legal framework; identify its financial, administrative, and budgetary effects on public health policy; and discuss its implications for equity in access and regional development. Adopting a qualitative approach grounded in qualitative analysis, with a review of theoretical and conceptual literature on development, as well as documentary analysis of materials related to the 2030 Agenda — the current global development agenda — and data on access to healthcare, the research mobilizes empirical evidence that reveals the impact of judicial action on planning and shared health management among federative entities. The analysis is based on official documents and databases from institutions such as the National Council of Justice (CNJ), the Federal Court of Accounts (TCU), the Ministry of Health, the Brazilian Institute of Geography and Statistics (IBGE), and international organizations. Drawing on a theoretical framework that integrates discussions on public policies and development, the study demonstrates that judicialization, while legitimizing the individual right to health, often destabilizes budgetary rationality and access to essential goods and services. The central research question is: how do judicial decisions that mandate the provision of specific treatments affect public health policy planning, budget allocation, and equity in access, and what are the effects of this dynamic on social justice and regional development? The analysis identified several challenges, including the need to strengthen intergovernmental coordination mechanisms, restructure primary healthcare, and enhance the technical advisory bodies that support the Judiciary, as measures to mitigate the negative effects of judicialization, particularly regarding demands for high-cost medications and procedures and the pressures they place on health system budgeting. It is concluded that the right to health, in order to fulfill its structuring role in development, must be treated as a collective public policy grounded in planning, adequate financing, and interinstitutional coordination.
