Dissertação (Mestrado Profissional em Direito Constitucional Econômico) - Centro Universitário Alves Faria, 2023.http://repositorio.unialfa.com.br/handle/123456789/365The objective of this paper is to identify the economic arguments analyzed by the Court of Justice of Goiás - TJGO, how they are considered and if they represent impeditive arguments for obtaining hospitalization in a bed of the Intensive Care Unit - ICU, based on the content of 84 processes found through data made available on the health panel of the Goiás judiciary and in the public procedural consultation available on the TJGO website, from January 2018 to December 2019. This is a study that used the decision analysis methodology - MAD to investigate the arguments that support the granting of the lawsuit and also a qualitative study of the bibliographic and documentary type, in which secondary data were collected on the number of ICU beds, available on the digital platform of the Ministry of Health and the Secretariat of Health, and the one advocated by the World Health Organization, as well as on the numbers of health judicialization available provided by the National Council of Justice. The result indicates that the most appreciated economic argument in judicial decisions is that of solidarity, followed by the Reserve of the Possible, the cost of hospitalization and the budgetary impact. It also points out that no economic argument was considered as an impediment to granting hospitalization in an ICU bed. Thus, although economic arguments are cited and analyzed in the decisions of the TJGO, the success of the request for hospitalization in an ICU bed is high and grows as the judicialization of public health increases in the TJGO, requiring a better dialogue between the agents involved.ptJudicializaçãoArgumentos EconômicosUnidade de Terapia Intensiva
