Therefore, it was necessary, based on bibliographical and jurisprudential research, to analyze the evolution of the subject under discussion, to expose and face the conflict of norms put on trial and to point out the failures and successes of the jurisprudential construction, in order to understand the path the legislation, the doctrine and the courts walked until culminating in the formation of a binding precedent that, in theory, contradicts the legislation put in place.
