The work stems from the observation of a scenario marked by land irregularities and the omission of the Public Power, revealing the urgency of addressing the problem. The research starts from the observation that, although the 1988 Federal Constitution establishes a set of principles aimed at the social function of property, the reduction of social and regional inequalities, and decent housing, its implementation encounters obstacles in the Brazilian land reality, where approximately half of urban properties present some degree of irregularity. The central hypothesis argues that the land registrar, as a delegate of public function and agent of economic activity, has the duty and power to promote land regularization with the Municipalities, acting proactively to overcome the obstacles that prevent the incorporation of informal urban settlements into the property system. This investigation follows three lines of inquiry: firstly, it defines the concepts of Economic Constitutional Law, emphasizing the principles of the social function of property, the reduction of inequalities, and decent housing. Secondly, it examines urban land regularization as an instrument for implementing these principles, analyzing its norms, procedures, and economic impacts, highlighting the RegularizAÇÃO Program of the Court of Justice of the State of Goiás. Thirdly, it characterizes the legal and economic nature of the land registrar and constructs the thesis of the duty-power to promote land regularization, demonstrating that this proactive action does not violate the principle of request. The methodology adopted is qualitative, applied, and exploratory in nature, with a deductive approach, employing bibliographic and documentary methods, with analysis of specialized national doctrine and the constitutional and registration normative framework.
