Dissertação (Mestrado Profissional em Direito Constitucional Econômico) - Centro Universitário Alves Faria, 2025.http://repositorio.unialfa.com.br/handle/123456789/657This work is motivated by a growing problem among the elderly population, particularly retirees or beneficiaries of Brazil’s National Social Security Institute (INSS), who are easy targets for entering into banking adhesion contracts with clearly abusive characteristics, lacking the capacity to discern their harmful effects. Among these contracts, the so-called “payroll-deductible credit card” or “credit card with reserved payroll-deductible margin (RMC)” stands out. This type of contract was specifically created and targeted toward certain groups: public servants, retirees, and INSS beneficiaries who receive their income via monthly payroll/check. The identified problem is that the minimum monthly deduction from a supposed credit card bill, coupled with the debt being refinanced the following month (since the full amount was not paid), along with the application of monthly fees, interest, and charges, causes the consumer’s debt to increase over time—even though monthly payments are never missed. As can be seen, the consequence for the consumer is disastrous: upon signing such a contract, the individual incurs an endless debt. For this reason, this study aims to analyze this contractual issue, which, despite being abusive, is legally permitted, and targets elderly retirees or INSS beneficiaries classified as hyper-vulnerable consumers. Given this motivation, the present dissertation seeks to demonstrate that agreeing to this type of loan constitutes a potentially abusive and harmful practice violating consumer rights. Furthermore, the expected outcome is that the principle of human dignity and the limitation of economic power abuse be recognized as constraints on the actions of financial institutions, compelling them to respect and uphold the fundamental mandates of protecting dignified human life. Financial institutions must not be allowed to offer contracts that lead to consumer indebtedness for the sake of unlimited profits. Additionally, more effective state and societal action is needed, such as investment in public policies promoting financial education targeted specifically at the elderly and hyper-vulnerable population, along with stricter economic regulation and enforcement of the constitutional principles governing the economic order.
