Its general objective is to study the divergences between laws and regulatory standards in the electricity sector and the impact on the judicialization of the sector, as the lack of clarity or conflicts between these two sources of regulation can cause uncertainty and disputes between the parties involved. In this way, the issue of the topic appears pertinent, because despite the existence of ANEEL Resolution 1000/2021, regulating specific rules on the distribution of electrical energy, it is important to highlight that modern doctrine and jurisprudence do not admit its isolated application, that is, the application of ANEEL Resolution 1000/2021 does not exclude the application of the Civil Code, or Law 8,078/90 (Consumer Protection Code).
