Dissertação (Mestrado em Função Social do Direito) – Faculdade Autônoma de Direito, São Paulo, 2023.http://repositorio.unialfa.com.br/handle/123456789/492This research deals with public accounts and the interconnection that exists between the effectiveness of contracts and administrative probity during the period of the Covid-19 pandemic. The absence of effective actions and the denialism in recognizing the seriousness of the problem that the world was facing proved to be crystal clear when subjected to the objective assessment of the responsibilities of public authorities. This study initially presents the principles of public administration as a preamble to the problem of public procurement bidding and its basic importance as a guide to conduct based on ethics and morality. It discusses the laws that regulate the process and the waiver of bidding of these administrative procedures and the historical context in which administrative reforms have been carried out in Brazil since the 1930s. It describes the changes brought about by the new Bidding Law, the benefits it promises and a special topic is dedicated to the criticisms made of it. The context of the Covid-19 pandemic in Brazil and especially in Amazonas, the scene of a major disaster in health care and administrative improbity are reported with consistent data. The cases of corruption verified in several states of the federation woke the country up to the debate on ethical issues and the importance of efficiency in dealing with public affairs, making the discussion that is made here about the disgrace and individual interests that prevailed over the collective urgent. It was demonstrated that the easing of standards used as a tool to minimize the impacts caused by the pandemic was conducted, in many cases, without due respect for ethical principles, generating vulnerabilities. Finally, the moral issues that involve public procurement and that are implicit in the Constitution of the Republic of 1988 itself were intensely violated, leaving visible the irregularities that are reported here, answering after all the question raised in the title of this Dissertation. The waiver of bidding for purchases in the pandemic, is it legal, but is it moral? These questions are answered in the conclusion of this research when demonstrating the urgent need for good governance, supported by strict foundations and efficient planning, in charge of a management that prevents or mitigates cases of misuse, fraud and corruption.ptLicitaçãoCompras públicasProbidade administrativa.ÉticaA dispensa de licitação para compras em tempo de pandemia, é legal mas é moral?
