Although the right to one’s image is part of the constitutionally protected personality rights in Brazil, the legal system lacks specific regulation regarding its post-mortem use, generating legal uncertainty and debate concerning the protection of the dignity of the deceased. In this scenario, the research asks: How can the technological advances of digital resurrection be reconciled with the constitutional principles of the economic order, particularly free enterprise, human dignity, and the legal limits on the economic use of deceased individuals’ images, in the absence of specific regulation in Brazil? The study adopts a qualitative methodology, with a hypothetical-deductive approach, supported by bibliographical and documentary research, and is structured around three main axes: (i) the conceptual and technological boundaries of digital resurrection; (ii) the legal framework governing personality and image rights after death, including an examination of national and foreign legislative experiences; and (iii) a proposal for normative parameters consistent with the constitutional principles of the economic order and human dignity. The dissertation concludes that balancing the interests at stake requires a hybrid regulatory model incorporating: prior consent from the deceased or, if unavailable, alignment with presumed will or professional activity in life; limited and criteria-based legitimacy for heirs; a defined time frame for the economic use of recreated images or voices; and mandatory transparency regarding the synthetic nature of the representation.
