Initially, it addresses the role of the regulatory state and agencies, discussing their functions in protecting public interests and promoting fair competition, especially in the face of market concentrations that challenge economic balance. The work then delves into Capture Theory, highlighting its origins and how it manifests in the Brazilian context, with a focus on the case of the National Supplementary Health Agency (ANS) as an example of an agency influenced by specific economic interests. Finally, measures and instruments are proposed to prevent or mitigate the capture of these entities, ensuring that they can fulfill their original role as public-interest regulators.
