The central problem of this research is: to what extent do the proposals of the Secretariat of Economic Reform (SRE/MF) to update Law No. 12,529/2011 manage to respond to the competitive challenges of digital platforms, considering regulatory experiences such as the Digital Markets Act (European Union) and the Digital Markets Unit (United Kingdom)? The justification lies in the need to address the structural anachronism of the current enforcement model in light of the specificities of digital markets. This study does not propose to supersede Law No. 12,529/2011, which remains adequate for traditional markets, but argues that, in the digital environment, the predominant revenue criterion and the essentially reactive logic are often insufficient to capture phenomena such as killer acquisitions, vertical integration of ecosystems, and systemic data control. Therefore, it advocates for institutional improvements capable of allowing coexistence between traditional instruments and specific mechanisms. The general objective is to critically analyze the proposals of the SRE/MF (Special Secretariat for Economic Relations of the Ministry of Finance), evaluating their legal and institutional adequacy. Specific objectives include identifying gaps in the current framework, examining the rationale behind the proposed pro-competitive obligations, comparing the Brazilian model with the European model, and proposing regulatory guidelines adjusted to the national reality. The method adopted is deductive, starting from the constitutional principles of the economic order and international paradigms of competition regulation to examine Bill No. 4,675/2025. This research employs a qualitative, theoretical-normative, and analytical-comparative approach, based on document analysis, systematic literature review, and several strategic case studies, through which it intends to test the formulated hypotheses. Its academic relevance lies in its contribution to the debate on the institutional adaptation of the Brazilian competition defense model to the digitalization of the economy. Even if Bill No. 4.675/2025 may be shelved, the research remains relevant by examining structural issues in the institutional design of the Brazilian Competition Defense System in the face of digital transformation, a phenomenon that transcends specific political conjunctures. Socially, the research addresses consumer protection and the encouragement of innovation.
