It só happens that, more than a decade after its entry into force, many Brazilian States and Municipalities have not adapted to its policy, continuing with the inadequate destination MSW, which causes several damages to the environment, social and economic. For the purpose of adapting the destination of urban solid wast, by municipal managers, a reflection was made on the self-compositional action of the Public Ministry, wich has negotiated instruments for the implementation of public policies and was erected, by the Federal Constitution, the permanent and responsible institution for the protection of an ecologically balanced environment. As for the procedures performed, bibliographic, exploratory and documentary research, the legislation applicable to the species and the projects carried out by the Public Ministry of Alagoas, Pernambuco, Paraíba and Mato Grosso do Sul were used. The theoretical discussions were based on authors who deal with the constitutional legitimacy of the Public Ministry to project the environment, its sel-compositional action, as well as on theories applicable to administrative, civil and criminal environmental liability. Still in a reflexive and discursive way, the four projects of the State Public Ministry of Alagoas, Pernambuco, Paraíba and Mato Grosso do Sul, were selected, anlyzed and discussed in an analytical way. The results demonstrate that the use of selfcompositional instruments available to the Public Ministry are effective in negotiations with public managers and able to eradicate dumps in Brazil, according to the experience of some Brazilian States.
