The study consists of the analysis of the organizational link of social business in relation to possibly compatible Brazilian legal institutes, seeking to identify similarities and differencesthat already exist between Yunus' ideas and Brazilian practice. In view of the result, we move on to a brief historical analysis of Brazilian economic development with a view to identifying how the state has acted over the years. Through the analysis of constitutional provisions, both current and past, we seek to reflect on the principals involved in the legal relations discussed here and on the role of the State in this field. Then, criticism is suggested to the Yunus watertight model and adaptations are recommended so that the desired results are achieved in national law. In this context, the application of the principle of subsidiarity is defended as a guiding principle between social business and state action, with a view to boosting socioeconomic development in a consistent, broad and sustainable manner. It seeks to demonstrate that the social business Yunus, although with conceptual inconsistencies and restrictions not necessarily right for the Brazilian reality, can be a relevant instrument to re-establish the balance of social relations, always with the support of the principle of subsidiarity. Finally, it is discussed the use of social business in the face of the phenomenon of uberization as a means of combating the precariousness of legal relations professionals generated by this phenomenon and the consequences and links between these concepts and a future for the capitalist model of production.ptNegócio socialInclusão socialDireitos humanosDireitos fundamentaisDireito ao desenvolvimento econômico na constituição federal brasileira: um modelo por fragmentação inclusiva
