Environmental protection and that of the economic order thus lack a uniform methodology when weighing their respective principles, more specifically when there is an apparent collision of conflicts between both when applying the principle of environmental precaution. With that in mind, this dissertation demonstrates the need for safer methodological criteria when weighing the precautionary principle with those of constitutional economic law by magistrates in their judicial decisions. It is believed that Humberto Ávila's theory of principles, with the use of his weighting method, responds to these concerns, ensuring a minimum objectivity of law, greater predictability of conduct and the controllability of these decisions. It is necessary to reduce legal discretion as much as possible.
