Autorregulação do mercado de transporte rodoviário brasileiro: análise do caso buser á luz das resoluções da ANTT do direito constitucional econômico. Goiânia (GO), 2025. 65 f. Dissertação (Mestrado Profissional em Direito Constitucional Econômico) - Centro Universitário Alves Faria, 2025.http://repositorio.unialfa.com.br/handle/123456789/687Enrolled in the research line "Economic Regulation, Competition Law and Business Promotion Policies", of the Academic Master’s Program in Economic Constitutional Law of UNIALFA, this study analyzes whether the regulation promoted by the National Agency for Land Transport (ANTT) in the road transport segment, through Resolutions 4,777 and 4,700, both of 2015, sets up an abuse of regulatory power to the detriment of Buser. It is assumed that the regulation imposed by regulatory agencies is predominantly analog, while technological innovations have a disruptive nature; such anachronism would hinder economic development, It would inhibit innovation, reduce efficiency gains and prevent falling prices to the benefit of consumers. The general objective is to examine the regulation of the road transport system in Brazil, in the light of a critical-propositive perspective anchored in the Economic Constitutional Law and the principles of the economic order (free initiative, free competition, consumer protection and development), with attention to the democratic environment. They are specific objectives: (i) discuss the roles of the state in the economy and the history of its normative role, dialoguing with the models of State and Law in Nonet and Selznick (2010) and with the concept of defeatability in Hart (2006); (ii) analyze the neoliberal society (Han, 2015), governmentality (Foucault, 2006), the figure of "man-company" (Dardot and Laval, 2016), the concept of disruptive technology and consumer-friendly regulation; (iii) delimit the role and limits of regulatory agencies, introduce notions of polycentric regulation and examine the regulation applied to Buser, differentiating between "open circuit" and "closed circuit", in addition to considering FIARC notes on possible abuse of regulatory power and notions of the Law of Economic Freedom. By articulating regulation, competition and fostering innovative entrepreneurial activity, the work seeks to contribute to the compatibility between state intervention, market efficiency and development promotion.ptRegulação econômica - Agências reguladorasTransporte rodoviárioAgência Nacional de Transportes Terrestres (ANTT)Autorregulação do mercado de transporte rodoviário brasileiro : análise do caso Buser à luz das resoluções da ANTT e do direito constitucional econômico
