The adverse possession, which originated in Roman law, underwent several changes, aiming to meet the wishes of the Romans, due to the problems they experienced in each phase of their history, but it was always an instrument whose objective was to stabilize, legally, a situation consolidated over time, bringing legal security and social peace. Time and possession have always been elements common to all types of adverse possession, although, in each era, the other requirements varied, according to political convenience. In this sense, the objective of this research is to present a contemporary reading of the institute of extrajudicial adverse possession, based on constitutional principles and values, showing, in the end, the influence of private property titling on urban development and the importance of adverse possession as a tool for land regularization. As a methodology, this qualitative research, of a descriptive nature, involves an empirical study, with the accomplishment of a documental research, through the analysis of documents, that is, of legislations and jurisprudence, as well as the accomplishment of the bibliographical research, in order to cross data for interpretation, substantiating the research. At this time, considerations about Law nº 13,465 of 2017 - Land Regularization Law are appreciated, as well as the analysis of practical cases that seek to highlight the role of extrajudicial adverse possession in the titling of private property and its importance for real estate regularization. In this context, the present study seeks to reread it from the perspective of the values currently in evidence, within a complex society and a dynamic reality, giving it new contours, always in search of solutions that meet the collective interests.
