The intervention of the Judiciary, in most of these cases justifiable, leads, on the other hand, to a more complex reflection regarding the role of this power in the current legal context and the limits that a judicial decision must adhere to in order to be considered legitimate, that is, how to prevent the discretion of the elected public manager from being replaced by the will of a judge who was not elected to make choices about public services or public policies, without, in turn, turning a blind eye to notorious cases of abuse and infringement of basic principles enshrined in the constitutional text, including mandates for the optimization of rights. This research aims to use a critical analysis of several authors, both from the legal field and from other areas of social sciences, to present a contribution on which parameters a court decision suspending a musical show should observe in order to be considered constitutionally correct, which includes refraining from being an activist. In this exploration, we will also verify which social rights a musical show can contemplate and whether economic aspects should be taken into consideration by the judge when issuing his decision, including how this should be done so that there is no breach of the autonomy of the Law by using, for example, a cost-benefit analysis that is not proper to legal science.ptDecisão judicialSuspensão de show musical.Perspectiva econômica
